and related issues.
What is Mediation?
Mediation is a confidential setting in which divorcing parties,
working with a professional mediator, settle their dispute privately.
Successful mediation allows the parties to avoid the trauma
and extraordinary costs of divorce litigation.
At your mediation, one of our retired judges will work with
both divorcing parties to reach agreement on all aspects of
divorce, including child custody, visitation, and division of
assets and debts. At the conclusion of the mediation, a written
agreement will be prepared. We encourage, but do not require, that you take the non-binding draft of the settlement agreement to a lawyer or other professional for review.
Both parties attend all mediation sessions. At the first session
your mediator will meet with both parties at the same time.
Unlike a trial, mediation is held in a polite, confidential
atmosphere. The mediator may also decide
to hold separate meetings with each party. Matters shared with
the mediator are not divulged to the other party without your
permission. This allows for the mediator to have access to the
greatest amount of information, so that he can help you craft
your settlement.
The goal of mediation is to resolve difficult disputes amicably,
and to avoid a trial at which a judge would make the decisions
for you. If you are contemplating a separation, divorce or termination
of a domestic partnership in California and considered consulting
with a divorce attorney, you may first want to explore the benefits
of working together with a former judge as a mediator. Divorce
mediation will not only save you the considerable time and expense
of an adversarial legal proceeding; it will also shelter you
and your children from the most harmful emotional effects of
your divorce. For these reasons, divorce mediation is a procedure
that more and more divorcing couples are employing. To learn more about Retired Judges Divorce Mediation Center,
